These Terms of Service apply to your use of the Keepsake Comics Studio website and to purchases made from Keepsake Comics Studio.

By using our website, submitting information or materials to us, placing an order, or purchasing a custom product, you agree to these Terms of Service and to any other policies applicable to your order, including our Refund Policy, Shipping Policy, and Privacy Policy.

About Keepsake Comics Studio

Keepsake Comics Studio creates personalized comic-cover artwork and finished framed gifts based on information, stories, photographs, and other reference materials provided by our customers.

Our products are custom-created rather than mass-produced. Each project may involve creative interpretation, illustration, photo editing, compositing, digital art tools, AI-assisted tools, manual editing, and artist review.

Custom Orders

When placing an order, you are responsible for providing information and reference materials that are reasonably accurate and complete.

We use the information you provide to interpret the person, story, personality, memories, interests, objects, pets, themes, wording, and other details that should influence the artwork.

You do not need to design the cover yourself. Creative decisions involving composition, pose, lighting, layout, typography, visual storytelling, and artistic presentation are part of the service provided by Keepsake Comics Studio.

The scope of a standard online order is described on the product page and order form at the time you purchase. Requests that substantially exceed that scope may require a custom quote or additional charge.

Customer-Submitted Photos and Materials

You may submit photographs, names, stories, sayings, logos, documents, screenshots, artwork, or other reference materials for us to use in creating your order.

By submitting material to Keepsake Comics Studio, you represent that you either:

  • Own the material or applicable rights to it; or

  • Have sufficient permission or lawful authority to provide the material to us and authorize its use for your requested project.

You remain responsible for the materials you submit.

Submitting a photograph to us does not transfer ownership of that photograph to Keepsake Comics Studio.

You grant Keepsake Comics Studio a limited permission to use, reproduce, crop, edit, transform, reference, and otherwise process the submitted materials as reasonably necessary to create, revise, produce, fulfill, and support your order.

This permission also allows us to provide submitted materials to technology and service providers we reasonably use in the production or fulfillment process, subject to our Privacy Policy and their applicable terms.

Public Display and Marketing

Submitting photographs or ordering artwork does not, by itself, give Keepsake Comics Studio permission to publicly display your personal photographs or finished custom artwork for advertising, social media, portfolio use, website galleries, or other promotional purposes.

If we would like to publicly feature your project, we will seek appropriate permission.

Copyrighted Characters, Logos, Brands, and Other Protected Material

Keepsake Comics Studio creates original artwork inspired by a person's real story, personality, memories, interests, hobbies, accomplishments, humor, and everyday hero qualities.

We do not agree to reproduce or create unauthorized copies of copyrighted characters, existing comic-book covers, movie posters, entertainment properties, logos, trademarks, or other protected creative works.

If a request refers to a favorite movie, television show, comic, game, team, brand, or other protected property, we may reinterpret the general mood, genre, humor, adventure, color feeling, or other non-infringing aspects in an original way.

We may decline, remove, or modify requested elements when we believe they could improperly copy or misuse another person's intellectual property.

Rights in the Finished Artwork

You own the physical framed product that you purchase.

Your purchase does not automatically transfer copyrights, source files, working files, prompts, layered production files, high-resolution digital artwork, or other intellectual-property rights belonging to Keepsake Comics Studio.

To the extent Keepsake Comics Studio owns intellectual-property rights in original elements of the commissioned artwork, those rights remain with Keepsake Comics Studio unless we expressly agree otherwise in writing.

This does not give Keepsake Comics Studio ownership of the customer's underlying photographs or other customer-owned materials incorporated or referenced in the project.

The finished framed artwork is sold for personal display and gifting unless a separate commercial-use agreement has been made.

Digital proofs are provided for review purposes and are not sold or delivered as high-resolution digital products.

Artistic Interpretation

Custom artwork involves judgment and interpretation.

Reference photographs may differ in age, lighting, expression, camera angle, resolution, hairstyle, clothing, or other details. Some elements may therefore require artistic reconstruction or interpretation.

Likewise, colors displayed on phones, tablets, and computer monitors can differ somewhat from the colors of the professionally printed piece.

Our goal is to create artwork that reflects the person and story you described, but no custom illustration can guarantee a photographic reproduction of every visual detail.

The proof process is your opportunity to identify reasonable corrections before production.

Proof Review and Approval

You will receive a digital proof before your artwork is printed and framed.

You are responsible for reviewing the proof carefully, including:

  • Names

  • Spelling

  • Dates

  • Wording

  • Likeness

  • Important objects or details

  • Overall composition and design

Reasonable corrections to the artwork already ordered may be requested during proofing.

A request to add new people, pets, objects, scenes, or substantially change the approved project concept may fall outside the original order and may require an additional charge or custom quote.

When you approve the final proof, you authorize Keepsake Comics Studio to proceed with printing, framing, and production.

Issues that were clearly visible in and consistent with an approved proof generally are not considered production errors.

Production Changes

Occasionally, we may need to make minor production adjustments after proof approval to prepare artwork for printing, framing, bleed, trim, sizing, color output, or other technical requirements.

These adjustments will not intentionally change the fundamental approved concept.

Pricing and Payment

Prices shown on the website are in U.S. dollars unless otherwise stated.

Applicable product price, shipping charges, discounts, and taxes are displayed during checkout when applicable.

Payment is required before we begin a standard online order unless we expressly agree to different terms.

Custom quote projects may have different pricing, scope, payment, shipping, or production arrangements. Those terms will be communicated before payment.

Shipping

Shipping availability, estimated carrier transit times, damaged-package procedures, and other delivery information are described in our Shipping Policy.

Production time and shipping transit time are separate.

Because each piece is custom-created and requires proof approval before production, placing an order does not mean the finished product will immediately enter the shipping process.

Cancellations, Returns, and Refunds

Because our products are personalized and made to order, cancellation, return, and refund rules differ from those for ready-made merchandise.

Please review our Refund Policy for the terms that apply to cancellations, approved proofs, damaged products, production errors, returns, and refunds.

Refusal or Cancellation of Projects

Keepsake Comics Studio reserves the right, at our sole discretion and subject to applicable law, to refuse, suspend, or cancel any project or order, in whole or in part, at any time before completion or delivery.

We may exercise this right whenever we determine that accepting, continuing, or completing a project would be inappropriate, impractical, unlawful, inconsistent with our business standards, or otherwise not in the best interests of Keepsake Comics Studio.

Reasons for refusing, suspending, or canceling a project may include, but are not limited to, situations in which:

  • The requested material appears unlawful, infringing, or otherwise legally problematic;

  • The customer does not appear to have sufficient ownership, permission, consent, or authority to provide or authorize the use of requested materials;

  • The request would require us to reproduce, imitate, or incorporate protected characters, logos, artwork, trademarks, copyrighted material, or other intellectual property in a manner we are unwilling to produce;

  • The requested content is sexually explicit, pornographic, exploitative, hateful, threatening, abusive, discriminatory, or otherwise inconsistent with the family-friendly nature, standards, or values of our business;

  • The project substantially exceeds the scope of the product or services purchased and the customer declines an appropriate additional charge or custom quote;

  • Required information, approvals, responses, photographs, or usable reference materials are not provided within a reasonable period of time;

  • The customer requests changes, content, or production methods that we determine we are unable or unwilling to provide;

  • The customer engages in fraudulent, deceptive, abusive, threatening, harassing, or unlawful conduct;

  • Continuing the project would create unreasonable legal, ethical, technical, production, safety, reputational, or business concerns; or

  • We otherwise determine, in our sole discretion, that we are unable or unwilling to accept, continue, or complete the project.

The reasons listed above are examples only and do not limit Keepsake Comics Studio's right to refuse, suspend, or cancel a project for any other lawful reason at our sole discretion.

If Keepsake Comics Studio cancels a project, any refund or other amount due will be determined in accordance with our Refund Policy, the circumstances of the cancellation, work already performed, costs already incurred, customer conduct, and applicable law.

Customer Conduct

You agree not to use our website, forms, upload systems, email, messaging services, or other services to submit:

  • Malware or harmful computer code;

  • Unlawful material;

  • Material intended to harass, threaten, exploit, or harm another person;

  • Material that you know you have no lawful authority to provide; or

  • Fraudulent or intentionally misleading information.

Third-Party Services

Our store uses Shopify and may use other third-party services for functions such as payments, file uploads, communication, analytics, shipping, and order fulfillment.

Your use of those services may also be subject to the applicable provider's terms and privacy practices.

Keepsake Comics Studio is responsible for its own commitments to you, but we do not control every third-party platform, carrier, payment processor, internet service, or technology provider involved in an online transaction.

Website Information

We make reasonable efforts to keep product descriptions, pricing, availability, policies, and other website information accurate.

If we discover a material error affecting an order, we may contact you to correct the issue before proceeding.

We reserve the right to update website content, products, prices, options, and policies prospectively.

Changes will not be used to retroactively remove rights already provided to you under applicable law or an existing completed transaction.

Privacy

Our collection and handling of personal information is described in our Privacy Policy.

Customer photographs and personal stories may contain particularly personal information. Please submit only materials reasonably necessary for your project.

Changes to These Terms

We may update these Terms of Service from time to time to reflect changes in our products, processes, technology, policies, or legal obligations.

The updated version will be posted with a revised "Last updated" date.

The terms applicable to a particular transaction are generally the terms in effect when that transaction is made, subject to applicable law.
